Payments: A NON REFUNDABLE 25% deposit is due upon booking. The payment balance is required in full, on the date of session. There are times in which a payment plan can be set up. Our scheduled time - It is mandatory that you be on time, If you are running late, please let me know. If it is more than 15 minutes late, we will reschedule, or it will be included in our session time. At times I book back to back session so it is important that you show up at the scheduled time. Cancelling/ reschedule If something comes up and you need to reschedule your session, it is necessary to do so, 24 hours before the time of your session. If you need to cancel your session entirely, please give 7 days notice. If you do not give 7 days notice and you cancel completely, your deposit will not be refunded . COOPERATION/NO SHOWS: Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions. If the photo session must be rescheduled due to clients cooperation where the photographer has traveled to reach the destination, additional travel fees will apply. In the extreme unlikely event that photos are lost due to corruption or equipment failure, PhotosbySarahkay is not held responsible for lost photos. Session will be reshot. Re-shoots are determined at the discretion of the photographer. After the session You will receive the amount of photos that we agreed upon, delivered through a password protected online gallery. : Client grants Photographer permission to display selected images resulting from this assignment as an example of Photographer’s work and for entrance into photographic competitions and releases all claims to profits that may arise from use of images Portrait sessions come with an average of 20 high resolution images with printing release. The number of images received is dependent upon the type, length, and cooperation of children, of each session individually. Photographer makes NO guarantees to number of images, image quality, or specific poses. All locations, situations, and lighting may vary, making every session unique. Images are delivered to the client electronically via digital download. Images may be used for personal use and sharing. *Digital images cannot be downloaded to cell phone or tablet. If you do not own a computer, you can order your images to be delivered on a custom USB flash drive for an additional fee of $25 Sales Tax All products are taxable for the state of Washington state sales tax Model Release I hereby give permission to o PhotosbySarahKay photographer, Sarah Kelley, the absolute right and permission with respect to the photographs that she has taken of myself and/or my minor child in which she may be included with others: -To copyright the same in the photographer’s name or any other name that she may select; -To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in an now or hereafter known, for photography related, purposes - including (but not by way of limitation) illustration, promotion, advertising and portfolio building Copyright SARAH KELLEY, photographer at photosbysarahkay retains all copyrights to all images created during client’s session. A print release will be provided with digital files to print portraits for personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or ALTERING of your images without the photographer’s written permission. Images are NOT to be altered, edited, or adjusted in any way. PhotosbySarahKay will post a sneak peek of a favorite shot(s) from the session on the Facebook/ Instagram page and encourages the client(s) to tag himself/herself and share with friends and family. Please note that the photos should not be altered in any way. *Photosbysarahkay cannot be held liable for any dissatisfaction of prints or products ordered from from places that were not recommended. By signing contract, you acknowledge that Photosbysarahkay orders only from top quality professional labs and image have been specifically calibrated for printing at such facilities. Prints and products ordered from third party vendors may not meet the same quality as those ordered directly from a professional lab. Photosbysarahkay cannot assist with any issues including but not limited to, color inaccuracy, product quality or upload issues. Printing is ALWAYS and HIGHLY suggested through MPix.com. PRINT LIFE: Client is aware that color dyes and inks in non-archival prints may fade or discolor over time due to the inherent qualities of dyes and inks, and Client releases Photographer from any liability for claims whatsoever based upon the fading or discoloration due to the inherent qualities when prints are not purchased from photographers recommendations. CREATIVE LICENSE. Images taken by photosbysarahkay are edited at their discretion. Delivered proofs may not include all captured photographs. PhotosbySarahKay reserves the right to edit and release only those images deemed creditable as professional in quality and within the Photosbysarahkay artistic standard. Client(s) may request editing that may be done if possible to complete at an extra charge. You may not request images to be retouched to your likings. Photography is an art form and there is a reason you hired a professional. Be sure to look at Photosbysarahkay work and post processing style before you book a session. Raw/ unedited Files will NEVER be released. SPECIAL PHOTO REQUESTS. Photosbysarahkay is willing to entertain any special requests of images that you have however, is not responsible if an image in unobtainable due the unwillingness of the session participants (including pets), unfavorable weather conditions, the unavailability of desired locations, etc. Photographic Limitations: Photosbysarahkay shall not be held liable for photographic opportunities lost or photographs deemed to be of less than superior quality due to inclement weather, man-made hazards or eyesores, lack of cooperation by the photography subjects, interference by guests, other wedding vendors or any other persons, or venue-imposed limitations on photo shoot locations, times, and/or Photographer's full use of equipment. Client agrees to all sessions being at their own risk and fully understands that at any time when working outdoors there are risks involved with terrain and elements. Photographer is not responsible for any injuries that may occur while shooting in any location. Although Photosbysarahkay strives for 100% customer satisfaction, photographer makes no guarantees to image quality or specific shots and or poses. We reserve the right to refuse service to anyone for any reason. If for any reason at any time the photographer finds reason to terminate this contract you will receive a full refund of your session fee. REFUNDS: Once the balance of your session is paid and your digital images are accessible for download, your order is non-refundable. Due to the custom nature of this work and the digital download system, no refunds will be given. Refunds will NOT be given due to “not liking a photo” or any other reason. Terms and Conditions are subject to change at any time without notice. In booking (defined as payment of retainer) your session you are agreeing to these terms and conditions as well as any future changes without notice. Photosbysarahkay is not responsible for any bodily injury or damage to personal property.
